1. Acceptance of These Terms

By accessing instastamps.com (the "Website") or placing an order, you agree to these Terms & Conditions. If you do not agree, please do not use the Website. "We", "us", "our" and "InstaStamps" refer to Silver Lake Inks Private Limited. "You" refers to the person or business placing an order.

2. Eligibility

You must be at least 18 years of age to place an order. If you order on behalf of a business or organisation, you confirm that you are authorised to do so.

3. Our Products

We manufacture custom rubber stamps, self-inking stamps, pre-inked stamps, embossers, and related products, made to order based on the text, logos, signatures, and designs you provide ("Customer Content"). Because every product is customised, each order is unique and manufactured specifically for you.

4. Your Responsibility for Customer Content

(a) You confirm that all Customer Content you submit is accurate, lawful, and that you have full rights and authority to use it.

(b) Stamps carry legal weight. You confirm that you are duly authorised to order and use any stamp or seal that represents a company, firm, professional designation (such as Doctor, Chartered Accountant, Notary, Advocate), signature, or official authority. We may, at our discretion, request supporting proof (such as a registration certificate, professional licence, or company authorisation) before manufacturing certain stamps, and may refuse or cancel any order without obligation if such proof is not provided or if we suspect misuse. We reserve the right to refuse any order involving government emblems, court seals, police insignia, military insignia, misleading authority marks, or any content that may violate applicable law or impersonate an official authority.

(c) You agree not to submit content that is unlawful, infringing, deceptive, or intended to impersonate any person, business, or authority. You are solely responsible for the use of any stamp manufactured from your Customer Content, and you agree to indemnify us against claims arising from your Customer Content or your use of the products.

5. AI-Assisted Ordering and Preview Approval

(a) Our Website offers AI-assisted features, including voice-to-stamp conversion, handwriting recognition, stamp recreation from photographs, and automatic translation into Indian languages. These features are provided to assist you, and while we strive for accuracy, automated transcription and translation may contain errors.

(b) Before your order is confirmed, you are shown a preview of your stamp. It is your responsibility to check the preview carefully — including spelling, numbers, language, spacing, and layout — before confirming the order. The preview you approve is the final artwork we manufacture. Errors present in a preview that you approved are not considered manufacturing defects.

6. Orders, Pricing and Payment

(a) All prices are displayed in Indian Rupees and are inclusive of GST unless stated otherwise. A GST invoice is issued for every order.

(b) Payment is processed securely through our payment partner, Razorpay. We do not store your card or banking details on our servers.

(c) An order is confirmed only after successful payment. We may refuse or cancel any order in cases of suspected fraud, pricing error, or breach of these Terms; in such cases any amount paid will be refunded in full.

7. Production, Dispatch and Delivery

(a) Orders confirmed before 4:00 PM IST on a working day are typically dispatched the same day. Orders confirmed after 4:00 PM, or on Sundays and public holidays, are dispatched the next working day.

(b) Delivery timelines depend on your location and the courier partner and are estimates, not guarantees. We are not liable for delays caused by courier services, weather, or events beyond our reasonable control.

(c) Please ensure your delivery address and phone number are correct. Re-shipment due to an incorrect address provided by you may attract additional shipping charges.

8. Cancellations, Returns and Refunds

Because our products are custom-made, special rules apply. Please see our Refund & Cancellation Policy, which forms part of these Terms.

9. Intellectual Property

(a) You retain all rights to your Customer Content. By placing an order you grant us a limited licence to use it solely to manufacture and deliver your products and to provide support.

(b) All other content on the Website — including the InstaStamps name, logo, designs, software, and AI features — is owned by or licensed to Silver Lake Inks Private Limited and may not be copied or used without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including business losses arising from the use or misuse of any stamp.

Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019 that cannot be limited by agreement.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Gurugram, Haryana shall have exclusive jurisdiction over any dispute.

12. Changes to These Terms

We may update these Terms from time to time. The version published on the Website at the time you place an order applies to that order.
